Scott Horton, a well-regarded moderate lawyer who teaches at Columbia School of Law in New York, thinks they probably will.

Writing in the relatively conservative New Republic, he says:

Both were assembling war crimes charges against a small group of Bush administration officials. "You can rest assured that no charges will be brought before January 20, 2009," one told me. And after that? "It depends. We don't expect extradition. But if one of the targets lands on our territory or on the territory of one of our cooperating jurisdictions, then we'll be prepared to act."

This is precisely the reason that the US refuse to sign on to the ICC.

Convicting in absentia only proves effective as a show, and hold no real promise that Bush, Cheney, Rummy, Rice, Addington, Yoo et al will ever be made to answer for their genocide and other crimes against humanity.

I believe there is still a very good chance that the US election is postponed indefinetely under the guise of war/terrorist threat.
If not, I would expect GWB to somehow construct a blanket immunity for himself and his war-crime cabinet before McCain assumes the throne.

I think the Europeans are just going to be glad that Bush is gone and back on his ranch in TX, come January 2009, and are looking forward to building a positive working relationship with President Obama.

How, exactly, would W “construct” a “blanket immunity” for himself?
