The outcome of this prosecution does not turn on the absence of DNA evidence. There is a ton of real, exculpatory evidence in favour of these accused, including a solid and verified alibi provided by a cab driver, (a mid-east Muslim immigrant, btw, one who was hauled in by the local D.A. and threatened with bogus immigration charges if he didn't recant. He didn't. He is a brave man)

The local DA is known to have suppressed much exculpatory evidence. He is also known to havemade myriad improper, unprofessional and even fraudulent statements to the media. He is an "old white man" by the way. His handling of this case is the subject of a 17 page complaint against him by the State bar. It is very likely that he will be disbarred.

In his news conference yesterday, the North Carolina Attorney General did not say "there is not enough evidence the have any reasonable prospect of a conviction", which is the usual prosecutor stance. He said that the investigation that his office has conducted shows these young men to be "I-N-N-O-C-E-N-T". He spelled it out just like that and stressed it. That is unheard of from a prosecutor.

This story is not about rape. It is not about race. It is about justice.

Oooh - charges dropped against rich young white guys. Stop the presses. This story may not be about rape any longer, and whether or not some form of assault actually occurred, we are not likely to hear about it in any court of law. It is most certainly not about justice, and it is most certainly about race. This represents the most incendiary image of the North American white supremacist construct - the fear and hatred constructed around the interracial rape image. Historically, thousand of men of colour have been viciously extra-judicially murdered while thousands of women of colour have had no recourse to sexual assault for hundreds of years. We can not pretend that the actions and arguments around this case are colour-blind and neutral. Moreover, who considers the situation of Crystal Gail Mangum, who is regularly smeared by the popular press and the right-wing wingnutosphere daily:
quote:
Her name is Crystal Gail Mangum, and she does not deserve to lick the underside of the shoes of hardworking and honest people of color and modest means who somehow manage to get through life without attempting to destroy and defile the lives of others.
These young men may well be exculpated but the term 'vindicated' suggests a degree of righteous vengeance they have no right to lay claim to.

That's justice alright. He said so, he said "I-N-N-O-C-E-N-T". So without a trial we must take his word for it not hers. Whatever. I'm fed up with listen to men talk about rape and women insult other women who have been assaulted. And nary a suspension in site.

Guilt or innocence was never going to be determined on babble but as a progressive discussion board one would expect a space in which critical analysis could be applied to dominant narratives and practices concerning sexual assault, race and the criminal justice system. It is necessary in this discussion to include an analysis of how the corporate media explicitly denies and dismisses the voice and experiences of marginalized people. Again you would think on a progressive board the voices, experiences and realities of marginalized people might be privileged above familiar and recognizable narratives originating from positions of power. Some people seem to have difficulty operating within such principles

Agreed. Try again.

I can keep shutting 'em down as fast as you guys can open them if you can't discuss this without provoking and polarizing.

Just opened to say that this time Michelle was .25 seconds ahead of me. Problem was, my lost post was fairly long winded.
