Well this seems a bit harsh.

5 years in jail! This is another example of insane over-reaction by the USA economic elites.
At worst, Hershey should have sent him a 'cease and desist' letter for trade infringement, but this chap was really asking for trouble by selling marijuana candies.
This was not a smart thing to do.

You do have to wonder what Hersheys expects to accomplish. Because of this suit the story has made it to half the newspapers in the world - if they wanted to bury this they didn't do it very well.

I can only imagine that it is intended to warn copy-cats that misusing Hershey's trademarks will be expensive.

That I believe is correct Sven, it's my understanding that copyright can be "whittled away" if potential infringements are not regularly challenged.

While it's true that the 5 years is for the pot part and not the copyright part, I disagree that it has nothing to do with "economic elites".

In my opinion, all punitive petty drug laws are an overreaction by the economic elites that make the laws. Because take a look at who goes to jail for them.

I'm unable to open the link above. Was this guy trafficking or just baking? If it was for personal use, 5 years is a horrendous sentence.
