Today, for the first time since 1938, the U.S. Supreme Court is hearing arguments as to whether the Second Amendment gives an individual any right to own/carry a firearm, or whether it is really only a "collective" right. Contrary to popular belief and NRA rhetoric, the Supreme Court has never previously held that any individual actually has a "right" to bear arms. If the Supreme Court goes in this direction, it could seriously limit state and local governments' gun control legislation. Here's a bit of press coverage:
Detroit Free Press: "Gun Control in the Cross-Hairs."
New York Times editorial: "The Court Considers Gun Control."
Linda Greenhouse, "Gun Control Case Causes Bush Administration Rift," New York Times, March 17, 2008.
Here's a link if you want to read the principal briefs or any one of the copious amicus filings:
District of Columbia v. Heller, Docket No. 07-290
A decision is expected sometime in June.
