INSTITUTIONALIZED DISCRIMINATION

I believed blindly probably affected by medications in OHRC’s propaganda I have been protected by law because of my mental disabilities & has become victim of its institutionalized discrimination

UNCANADIAN, OPRESSIVE, OFFENSIVE TO HUMAN DIGNITY TREATMENT

OHRC called medical evidence calling for peace of mind because I was dying "stalling tactics".

OHRC Chief Commissioner's priority was to allocate all resources to guarantee right to have party than uphold dignity of a family, did not care I could die any minute & ignored my pleas “not to destroy my faith in humanity ” failed to accommodate me & intentionally inflicted mental shock on me while I was dying.

TOTAL DISREGARD FOR SUPREME COURT OF CANADA

Judge Ron Fratkin said: As I say, the public, at least in Canada, I think, has always lived by the sort of guiding principle, you don't kick somebody when they're down”.

OHRC Chief Commissioner has orchestrated campaign of dignity denial to marginalize.

TOTAL DISREGARD FOR THE CHARTER

S 15(1) of Charter provides:
Every individual is equal before & under the law & has the right to the equal protection & equal benefit of the law without discrimination &, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.

OHRC violated my dignity & discriminated based on disability when it ruled that PSTD is not disability.

FRAUDELANT CONCEALMENT

OHRC investigator did lie she could not find witnesses while she knew they were threatened not to testify, withheld the fact that my manager was fired because he harassed other person at the same time he did it to me.
There is also new evidence because my witness has filed complaint with OHRC but OHRC marginalizes me because I am sick and defenceless victims because I am sick & poor & cannot afford lawyer.


REPRISAL TO CRACK DOWN ON DIGNITY & EQUILITY PURSUIT

OHRC knows my wife supports but it still wanted costs from me knowing it is going to impose financial hardship & hurt my family. This low conduct is standard for human rights abusing regime which demand that political prisoner's family pays for bullet used in execution.

BAD FAITH

OHRC investigator in manipulative manner destroyed or withheld all evidence supporting my case such as emails, manuals and urged me to drop it and file wrongful dismissal lawsuit when at the same time prejudiced and barred my case by filing her report.


OHRC CONDONES INSURANCE FRAUD

OHRC condoned insurance fraud when it allowed to obtain premium payment from me for benefits it was not going to pay.


TOTAL DISREGARD FOR ITS OWN POLICIES

OHRC violated my dignity when it refused to consider accommodating me based on my disabilities & denied it on employer’s opinion; failed to take into account my medical conditions & accurately reflect my complaints;
discriminated against me when it failed to consider calling me job interviews;
OHRC discriminated when refused to accommodate me based on disabilities & forced me to testify early in the morning while on medications

TOTAL DISREGARD FOR THE ONTARIO HUMAN RIGHTS CODE

OHRC failed to remove & condones the barrier, deliberately marginalizes, violates my dignity,equality rights when they rejected mental anguish, humiliation, hurt feelings & loss of self-respect suffered because of discrimination.

OHRC BREACHED DUTY OF PROCEDURAL FAIRNESS

It has been driven by bias & prejudice when they breached duty of procedural fairness when it condoned illegal practices of spying on me by Crawford. & ignored mandates & allegations of poison working environment, termination & deductions were reprisals

OHRC deliberately has shown calculated, willful & reckless disregard for the law & material before them because of my mental conditions when issuing their bad faith, discriminatory, oppressive & patently unreasonable decisions & ignored its mandates to investigate allegations of poison working environment; illegal termination & deductions were in fact reprisals for enforcing my basic human & labour rights.


OHRC investigator acted in bad faith & discriminated against me she ignored all evidence & told me to file wrongful dismisal because OHRC "does not like such cases", acted in bad faith when told my request to allow my wife to help with workload did not constitute request for accommodation.

I do believe that all your allegations are well founded, that you have been abused, oppressed and taken advantage of (because of your lack of financial means) by the totally discredited and corrupt Ontario Human Rights Commission.

Ever since the mid 1980's this abominable agency has been inflicting indignities, abuse, disdain and total disregard to the very people it is supposed to protect. It has displayed total disregard to the Ontario Human Rights Code it is supposed to administer, to its own policies and procedures, to fundamental fairness and natural justice and even to the Criminal Code of Canada.
Yes, to the Criminal Code of Canada. (Fraudulently sending a fake and forged decision to a complainant is a violation to the Criminal Code of Canada and that is exactly what OHR Commission staff did and were never called to account for by successive Ontario regimes, Liberal, Conservative and NDP).

The fact that since the coming into effect of the Equality provision of the Canadian Charter of Rights and Freedoms (in 1985) may have caused the volume of cases to dramatically increase, while the human and financial resources of the commission did not increase as much.

But does that justify Commission staff taking liberties with complainants' human dignity and legal rights by cutting corners, stifling complaints at any cost, including violation of the Criminal Code of Canada.

Successive Ontario governments imlpied a "Yes" to the question, through their stonewalling and refusal to lay charges against Commission officials. They obviously feared a floodgate of lawsuits should the matter be exposed to the public, to unwitting complainants who have been duped by fake decisions.

I really sympathize with you, brother ! I know what you went and are going through. I am a social worker and I have seen and witnessed what the Commission is "capable" of. It is above the law, period. Try to complain to the government, your MPP or any authority and here is the reply you will receive:

"The Commission is an independent agency that operates at arm's length. The government cannot interfere.."

Nice way out, isn't it !!

Holy Moly. Sounds like an ugly situation for sure!

I don't know the rules or available advocacy services in Ontario. Do you know if there are any legal counseling services you can access to maybe even get a lawyer to look at your case?

I can't think of anything else off the top.

I am not surprised at all. I remember well the OHR Commission making the headlines with its never-ending scandals and every time the government of the day rushes to sweep everything under the carpet.

Here is an article from the Toronto Star, July 23, 1991. The government of the day was NDP, supposedly "caring" about minority rights, equality and social justice. It did nothing, not counting cover ups.

It's time for Queen's Park to step in to clear up the seemingly endless mess at the Human Rights Commission. Over the years, the commission has managed to render the finely worded Ontario Human Rights Code a toothless tiger.


The body charged with enforcing the code is floundering out of control, as pointed out in an extremely critical report by Ontario Ombudsman Roberta Jamieson (excerpted on the opposite page).

Her conclusions shouldn't come as a surprise.
In 1989, chief commissioner Raj Anand had to resign amid allegations of inept management and discrimination within the commission against
minorities.

Last summer, a consultant's report cited internal racial tensions, overwork and low morale at the commission's West Toronto office in Mississauga. Other studies have revealed gross inefficiencies.

And now, Jamieson has concluded that the commission is unable "to effectively carry out its mandate."

Citing unacceptable delays in processing its case load, she has labelled the commission's investigative methods "unreasonable and oppressive," causing "extraordinary and perhaps unconscionable hardship" to victims of
discrimination.


Worse, Jamieson reports a lack of co-operation with her inquiry. She says senior staff tried to undermine her probe by initially denying her
statistics and access to staff.

This is in keeping with the commission's sorry track record. Confronted with critical findings, it usually engages in obfuscation and tries to
malign the critics.

Where does the commission go from here?
People who've been discriminated against may continue to keep their complaints to themselves, if only to avoid the hassle and delay. And perpetrators of discrimination will operate in the knowledge that they'll likely not be brought to account.

Premier Bob Rae should consider placing the commission in the hands of a proven administrator, with a broad mandate to end the case backlog in reasonable time.

Rae may also want to redefine its mandate, so it can put more time and energy into eradicating systemic discrimination - and to propose a more
efficient method for processing individual complaints.


Bob Rae's government established a "Task Force" to look into "the operations" of the Commission (mind you not the abuse it inflicts upon complainants). The report of the Task Force was shelved to collect dust.

I agree with Bohajal's statement that by refusing to seriously investigate the OHR Commission, successive governments were motivated by fear of an avalanche of lawsuits from unwitting complainants and those who have been abused.
