In 2000 my exe husband contacted Revenue Canada and said my kids hadnt been living with me and he was entitled to Child Tax Benefits, Federal and Provincial since 1998. Not true. Revenue Canada informed me I had to pay back money to them, it ranged from $1500.00 to a high of $8500.00 at one point, an amount which made NO sense at all. No one could seem to agree just what the debt really was. They took my tax return for 2000 and 2001 and held it against this debt.

I appealed, it ended up in tax court, I won. (Naturally I never lie on my returns because it just isnt worth the hassle).

Through the course of the appeal which was decided AGAINST me an employee with Revenue Canada was disciplined, so I was told, for making a stupid decision. He should not have denied the appeal and found in favour of my exe who had no evidence for his claim. It has been a 3 year fight with them ending in Tax Court.

I no sooner got that decision then I got a notice they were auditing my 2001 return and I had three weeks in which to comply with all information and receipts or I would owe them $4500.00 this time. They said I couldnt claim moving expenses and we all know you can.

Just got that done. and it turned out they owed me money !

Now my husband received a notice (yesterday) that his return is being audited for 2001 and as he has FAILED to comply, he didnt receive ANY correspondence from them, he now owes them $3500.00. In the letter he received they said he cant claim education expenses or legal fees for collecting wages owed to him, we all know those are legal deductions.

They claim returns are selected AT RANDOM for audit however this is beginning to feel an awful lot like harassment to me. All the deductions they say cant be claimed ARE legal under the Income Tax Act.

What do you all think? I think they took their loss in Tax Court badly and this is the spin off.

Sounds like harassment to me too, Kindred, the way you tell it. That's really crappy.

I guess all you can do is fight it. And you're right, it's total BULLSHIT that you can't claim education amounts AND tuition.

Ah, crap. I thought they went after your ex for back taxes initially. Didn't realize they had actually gone after your current husband.

However, it sounds like your ex started a snowball that he is going to regret, especially if this comes up in divorce court proceedings down the line and you can introduce evidence that shows that RevCan has decided to audit you more frequently because of false allegations on the part of your ex.

Actually Doc charges are pending I believe against my exe, the person who sort of told me this, told me she couldnt really tell me -- Before this he owed them $12,000.00 for deductions for CS payments he had claimed he made and didn't. So I sure dont know why they would take his word for anything. The guy who made the decisions on my file was apparently found to be in trouble with HIS ex wife for not making CS payments.

I might write to the AG's office about all of this and see if he feels enough is enough.

Changes on my tax return after separation must have set off flags at Rev. Canada. They reviewed my return and requested some additional information.

What I wanted to do was phone up the guy making the inquiries and say "Let's just pretend my last name is Bronfman, asshole." It was the same year when Rev. Can was in trouble for waiving the tax laws for the Bronfmans.

But, I was wiser than that. I supplied them with the information he requested (and only that information) in a timely manner, along with my home phone number and a time to reach me (the time given in his time zone) if there was anything else he needed clearing up.

I never heard back.

After going through separation, I think anyone who would reinvite legal troubles is a complete and total idiot.

I think the same thing happens to most people, Tommy. I was living with a boyfriend common-law before meeting my husband, and when I broke up with him and left, I got a call from Rev Can the next tax return, asking about my status.

Same thing happened the first tax return after being separated from my husband.

I think they just call and confirm, that's all. No big deal.
