In view of Jeffs info that these 6% rates are arbitrary I am now going to attempt to find a new realtor. Everyone I have ever spoken with insists that these rates are "set" and cant be "bargained". So now I know this isn't true and they are misleading the public.

I have found one way to "get around" that is to have a friend who is a realtor "refer" me to one in my area; the commission has to then be split with her and she of course just sends her share back to me. This works well if there are only 2 realtors involved in the sale, then I get 50% back. However if there are 3 it then becomes only 33% ...

Rather than doing all this side stepping I want to find one who will be honest enough to bargain and offer them 3% on the first $1000.000.00 and 2% on the balance over $100,000.00.

This seems fair to me. I dont see why anyone should be paid $8,000.00 to $10,000.00 for selling my house. I worked hard improving it, out my own money nto it and their part is so small - an ad in the paper, a blurb on the internet site. A few showings.

Further I have been asking since January that the wording of the ad on the net be changed and he hasnt done it. So I feel that I am getting very very little for the money he expects to receive.
Therefore I am not renewing his contract and now searching for a new agent.

Any ideas?

Ask them to put it in writing, as you have been told that this would be illegal, and would like to check it with the authorities.
