Woo Hoo I was so excited when I saw this headline I haven't even read it yet.

NEW YORK - Parts of the controversial U.S. Patriot Act have been declared unconstitutional.

A federal judge in New York issued a ruling on Wednesday, in favour of a challenge by the American Civil Liberties Union.

The ACLU questioned the power the FBI has to demand confidential financial records from companies as part of terrorism investigations. Under the act the FBI can demand confidential customer records from communication companies, such as internet service providers or telephone companies.

But Judge Victor Marrero said that "democracy abhors undue secrecy" and ruled in favour against the U.S. government, saying the act goes against constitutional protection against unreasonable searches. He also said it violated free speech rights.

... not complaining... just thought the thread deserved a bit more visibility, maybe by being in the news forum, that's all...

As to the story... how much you wanna bet BushCo™ doesn't appeal this? They can't afford to let this ruling stand unchallenged. (Not if they don't wanna get their little theocracy upset like an applecart, anyway...)

When I saw the headline I was hoping to see something about stopping them from looking at library records. I wonder if that has been ruled on?

to be strictly accurate, Judge Marrero stuck down part of a 1986 law 18 U.S.C. § 2709 as unconstitutional which has little bearing on the Patriot Act. The latter made some minor wording changes but the regulation in question has been available to the FBI for the better part of 20 years.
